Timo Kulczak is suing the BBC star for £70,000 after she accused him in her autobiography of restricting her access to cash and even deciding what she eats.

Motsi, 42, has now refused to settle the court order – meaning the case is going to court.

In a bitter twist, Tim’s lawyers also asked the court to jail the dancing legend for up to six months or fine her £250,000 if she ever repeats the claims in her book.

The measure was introduced as part of a “cease and desist” clause in the order.

The team’s lawyer, Samy Hammad, said: “Mrs Mabuse refuses to pay, so the court must now decide.

“All we want her to do is retract the falsehoods published about him and compensate him accordingly.

“My client’s reputation has been damaged several times.

“You have to threaten punishment and say if you do it again, that’s what I want in terms of money or in terms of jail time.”

Motsi alleges in Finding My Own Rhythm: My Story that during their 11-year marriage, Timo, 45, paid her an allowance from her dance lessons and TV earnings.

She also says he refused her pleas to have a child and controlled her diet – allegations he denies.

According to the order, Motsi must stop “implying that the plaintiff caused the defendant to suffer during their marriage”.

She is also asked to “publicly declare the untrue statements published in the book and quoted media articles”.

The lawsuit was filed at the regional court in Offenburg, Germany.

As a German citizen, sources say Motsi cannot ignore it.

She will be given a deadline to respond, and failure to do so could result in a default judgment.

If the hearing goes ahead, Motsi or her lawyer would have to appear.

Motsi and Timo — who met at a dance tournament — got married in 2003.

They divorced in 2014.

Motsi moved to Germany from her native South Africa at the age of 18 to be with him.

She married her new dance partner Evgenija Vozynuk in 2017.

The couple has a daughter and together run a dance school near Frankfurt.

Motsi, who is the sister of two-time Strictly winner Oti Mabuse, 33, was a contestant and judge on Germany’s Let’s Dance.

She joined the Strictly 2019 judging panel, replacing retired ballerina Darcey Bussell, 54.

Tonight, Motsi’s spokesman said there was “no legal basis” for Tim’s claim.

They added: “It is not true that our client faces jail time in connection with her ex-husband’s civil suit or that the fine, which would only be paid if our client wrongfully violates a court order, would be more than a nominal amount.”
