This Friday, the Constitutional Council censored the essence of the LREM law, which provides for “security measures” for terrorists detained in prison, considering that many of the provisions prescribed in the text “violate” various fundamental freedoms.
In their decision, the scholars consider that these measures, which should have been imposed based on the “special dangerousness” of the prisoner, “affect the freedom to come and go, and the right to respect private life and the right to drive a normal family life.

This controversial bill was finally adopted by the National Assembly at the end of July. Faced with the controversy, Justice Minister and former lawyer Eric Dupond-Moretti called for a “balance of solutions” and assured that he did not “suddenly seize the blinding madness of liberticide.”
The text opened up to the judicial authorities the possibility of imposing from five to ten years on people convicted of criminal acts of terrorism, upon expiration of the sentence, the obligation to respond to the calls of the judge who handed down the sentence, to establish their residence in a certain place, prohibitions to engage in relationships and it seems in some places, and still be obliged to point out that, with the consent of the person, wear an electronic bracelet. These measures should be limited to persons sentenced to terms of more than five years in prison.
In its decision, the Constitutional Council detailed the measures it considers to be against fundamental freedoms. “In particular, it is the obligation to establish residence in a certain place, the obligation to report periodically to the police or gendarmerie units, up to three times a week, the prohibition to carry out certain activities, the prohibition to enter into a relationship with certain people or stay in certain places, categories of places or areas, and the obligation to respect the conditions of health, social, educational or psychological care”, writes Mudri, thus censuring the essence of the law.
