In the latest legal victory for activists, a judge in Angeles City, Pampanga, acquitted former CPP chairman and NPA commander Rodolfo Salas of illegal weapons possession, finding it illegal to search his home without a warrant.
“The conduct of a search clearly violates the defendant’s constitutional protection right against arbitrary search and seizure. Because they are the “fruit of a poisonous tree,” under the rule of immunity in Article III. Section 3(2), firearms and ammunition seized from the defendant were not admissible as evidence in court, Judge Ramon Corazon Blanco 58th Branch of the Magistrates Court, but the decision was not reached Friday for the City of Angeles (Salas) , August.
Salas was detained on February 18, 2020, according to a 2019 arrest warrant issued by the Manila Regional Trial Court (RTC) in connection with a murder case involving a mass grave in Leyte containing the victims of an alleged communist purge. The continued campaign against the leftist side of the Duterte administration has resulted in the issuance of arrest warrants for Salas, CPP founder Jose Maria “Joma” Sison, senior adviser Luis Jalandoni of the National Democratic Front (NDF) and others.
Salas, who according to his attorney had “long retired from the CPP” and “remade his life with his family in Angeles City,” was charged with unlawful possession after police discovered a gun and ammunition at his home.
Homicide cases cannot be bailed, but illegal weapons possession cases do. However, after an oral hearing at the Supreme Court in March 2020, the judges decided to release Salas on the murder charge. He has been free since then. The investigation into the Manila murder is ongoing.
The Free Legal Aid Group (FLAG), Salas’ attorney, won the objectionable illegal possession case. Salas is not required to provide evidence if the objection is accepted because, as the judge noted, “the prosecution’s case is unsupported.”
The three arresting agents said they clearly saw a gun and bullets on the computer desk when Salas took the glasses from the same desk because they did not have a search warrant.
In principle, the apparent point of view theory allows law enforcement officers to seize goods they clearly see that they believe could be evidence of a crime.
But throughout the trial, the police continued to clash with each other and with themselves about where they found the guns and ammunition: first on the computer desk, then in a desk drawer, then on a nearby file cabinet.
The barangay policeman, who was required to be present when the order was executed, claimed that he had been at Salas’ doorstep for 30 minutes. The police claimed that the barangay official was present in the living room the entire time, but this statement refutes that claim.
