On Monday, Balenciaga confirmed that the papers were from the 2008 supreme court case, which concluded that it was not unconstitutional to ban the promotion of child pornography.

Balenciaga said the North Six ad was supposed to present random documents in the background and “was aimed at replicating a business office environment.”

“All the material included in this shooting was provided by third parties who confirmed in writing that these props were false office documents,” said the statement. “They turned out to be genuine legal documents, probably from the shooting of a TV Drama.”

Balenciaga is suing North Six and its set designer Nicholas Des for significant damage caused by an advertising Campaign Balenciaga hired them to produce.”

Balenciaga states, “members of the public, including the media, have falsely associated Balenciaga with the repulsive and profoundly disturbing subject of the court’s ruling.”

Late Friday, Balenciaga filed a lawsuit in Manhattan against the production Company claiming the documents were used without Balenciaga’s knowledge.

Nicholas’s agent, Gabriel Maussaieff, stated that the post and the papers used in the ad were rental pieces obtained from prop House used in films and photo shoots.

He added, “Everyone from Balenciaga was on the shot and worked on editing every image in post-production.” Maussaieff also stated that her client is being used as a scapegoat by Balenciaga.

Many consumers have been quick to question what many refer to as attempts by the brand to shift the blame from the situation.

Balenciaga approved the final image before they posted it on social media; it seems unlikely that Balenciaga’s Contract with third-party creative needs to include the term by which Balenciaga has the absolute right to the image before being posted.

Continuing with its investigation into the matter, Balenciaga stated that it is taking responsibility for the lack of oversight and control over the Campaign images.

Balenciaga brand ambassador Kim Kardashian stated she is “re-evaluating” her connection with the company. The unsettling sights left her feeling “shaken.”
