According to the doctor’s widow, her husband got infected on the guard, while there were no FFP2 masks in the hospital.

Clear Loupiac, the wife of a doctor who died of Covid-19, decided to go to court to get compensation. Her husband, Eric Loupiac, an emergency physician at the Lons-le-Saunier hospital in the Jura region, died last April at the age of 60 from an infection with the new coronavirus.

The widow of the manager of the Association of Emergency Doctors of France (AMUF) filed a lawsuit against X on Monday for “involuntary manslaughter, failure to render aid to a person in danger and failure to rescue,” The World reported.

after Clear Loupiac, her husband could not get the virus anywhere else but his workplace, to the extent that he was locked up with his family from February 26 and was out to secure his guards at the beginning of March. According to her, even during the detention from March 6 to 8, her husband was infected, so he had to use surgical masks, not FFP2, in order to be more protected, writes The World.

Nine complaints against the government

Positive for Covid-19 on March 17, Eric Loupiac died on April 23 in Marseille after being admitted to the intensive care unit. His wife complains that the director of the Lons-le-Saunier hospital did not equip doctors with FFP2 masks and did not set up a patient triage system in the hospital’s waiting room. According to her, in this configuration, unmasked and not yet aligned patients are likely to come into contact with medical personnel who were not sufficiently protected.

The complainant stated that her husband warned the Committee for Hygiene, Safety and Working Conditions (CHSCT) about this situation on March 2, but that the hospital management would clean up the CHSCT’s remarks.

Unlike many prosecutors, the widow chose not to file a complaint against Health Minister Olivier Véran, as well as his predecessor Agnès Buzyn. On July 7, the judicial information was opened and entrusted to the commission instruction of the Court of Justice of the Republic (CJR). This instance – the only one competent to try members of the government for their actions in the exercise of their functions – is currently investigating former Prime Minister Édouard Philippe, Agnès Buzyn and Olivier Véran for the criminal offense of refraining from participating in the fight against crime. To date, nine of the 53 complaints received have been selected.
