False witness, slanderous denunciation: Raoult vs. Hirsch, a quarrel in 4 acts

The president of AP-HP and the director of the Institute for Mediterranean Infection engaged for a month, fierce media and legal battle.

Nothing is going well between the director of Assistance publique – Hôpitaux de Paris (AP-HP), Martin Hirsch, and Marseille professor Didier Raoult. The controversial head of the Institute for Mediterranean Infection, it was revealed this Thursday, filed a complaint with the Paris Prosecutor’s Office against Martin Hirsch, who accused him of “false testimony” at the beginning of July.

The culmination of the tension between the two since June 24, this complaint was filed for “defamatory defamation.” Express returns, in four acts, to that theme.

June 24: Pr Raoult’s return to the Commission

It all starts on June 24 last year, when the media professor Didier Raoult himself, known for his views strongly supporting the controversial hydroxychloroquine, is speaking before a parliamentary commission of inquiry into the management of the Covid-19 issue of mortality during the epidemic. Providing on-the-job support available online, he thus shows that mortality in French intensive care units has reached 43%.

“For us it was 16%,” he says then, without specifying the exact sources. Contacted by AFP, a few days later, Pr Raoult’s entourage finally returned to the Reva (European Research Network for Artificial Ventilation) results register, as contained in the “April 14 AP-HP crisis unit report”. In this document, which dates from three and a half months ago, during the peak of the epidemic in France, the percentage of deaths in the IC was estimated at 43% according to AP-HP and 41% outside AP-HP.

“The task has been put on the back burner”, the doctor does not hesitate to catch during the hearing, stating that the 80-year-old Chinese patient, who is considered the first patient of the coronavirus in Paris, presented “at the Pitié- Salpêtrière Hospital in Paris” was “return home”, then “income after 7 days” and “came to die in the hospital”.

June 26: Martin Hirsch accuses Raoult of being a “false witness”

Considering these figures, the director of AP-HP does not need to react for a long time. It seems that these statements “reduce to false testimony”, accused t-il in a letter to the Speaker of the National Assembly on June 26. Two days after Pr Raoult’s intervention before the Commission, Martin Hirsch wrote to Richard Ferrand “that [it] It seems that it is important that the work of the commission can be based on the elements of factual inaccuracy, and that the suites that are requested can be provided”.

In this letter, Martin Hirsch specifically disputes two passages from the hearing of Dr. Didier Raoult before the commission of inquiry on June 24: on the one hand, his assessment of the mortality rate of ICU patients, and on the other hand, on an 80-year-old Chinese patient who was hospitalized in Paris at the end of January and died in mid-February – the first death from Covid-19 officially registered outside Asia.

“These statements, which have seriously questioned AP-HP, given under oath, seem to me to be false testimony,” accuses Martin Hirsch in the letter. The director of AP-HP also assures that he has in his possession “any data showing mortality of up to 43% in AP-HP resuscitations”, without specifying how much this rate increases. “On the other hand, there is no published study to date that compares ICU mortality rates, assessed under controlled conditions, between hospitals in Paris and Marseille,” he adds.

Finally, “one 80-year-old Chinese patient who can be referred to as Pr Didier Raoult was admitted on January 25, 2020 to the European Georges Pompidou Hospital. He was never sent home,” says Martin Hirsch in his letter. We remind you that this patient was then transferred “to the Bichat Hospital, a national reference center”, where his daughter, who was also ill, was treated before she recovered.

July 6: Martin Hirsch disputes Raoult’s figures before the Commission

During his own hearing before the commission of inquiry, on July 6, Martin Hirsch does not hesitate to question again the figures published a few days earlier by Didier Raoult. Having data from Si-Vic, the Ministry of Health’s system for monitoring patients in the event of a medical emergency, the director of AP-HP indicates that the death rate in the intensive care unit “appears today on public assistance to be 25%”. According to another source, a patient cohort compiled by AP-HP to monitor patients supported in its 39 hospitals, “we believe this rate is between 31% and 35%,” adds Martin Hirsch. Figures far less than the 16% mentioned by Didier Raoult.

On the April 14, 2020 AP-HP crisis unit report, Martin Hirsch confirms the authenticity of the document, but wanted to emphasize that it was dated “almost three months ago and so out of date”. At that time, according to the same document, about half of the patients hospitalized there for resuscitation were still admitted, and “did not yet know the outcome of their illness [death or healing], adds the director. “No one can give a definitive death rate today: we still have patients who are in intensive care and we hope to save them,” he insists. “My role is not to make percentages for the police, but if they want [influence] Investigative commission based on the data to be biased and biased, my role is to react promptly,” he said in front of the representatives.

Pr Raoult was “serious accusations” in “and implied that we would be criminals, because we would let patients die (…) because we would not give” hydroxychloroquine to patients, pounds and further Martin Hirsch in front of the commission, pointing out that “comparisons mortality rates were only relevant if they took into account the number of patients admitted, the severity of symptoms or even the proportion of elderly patients.

When you have “small patients to take care of, you can more easily put patients on resuscitation,” which “has an impact on the mortality rate,” Martin Hirsch said on July 6, reconfirming that the first patient with the coronavirus in Paris was a Chinese tourist. 80 years old, he was certainly not considered a suspect for Covid the first time, but that he was “treated as such” at the Georges-Pompidou hospital and that he “never left the hospital” before his transfer to the Bichat hospital, contrary to the claims of Didier Raoult.

July 30: Raoult files a lawsuit against Hirsch

After several weeks of radio silence on this case, Professor Didier Raoult was finally informed that a report was filed against Martin Hirsch at the Paris prosecutor’s office for “slanderous denunciation”, we learned this Thursday from several sources. “Up here it was about scientific controversies that have always been there, Professor Raoult was always ready to start controversies, but here it goes beyond the scientific sphere,” said Mrs. Brice Grazzini, the Marseille-based doctor’s lawyer, confirmed that he had filed the complaint on Wednesday.

Since the beginning of the epidemic, Didier Raoult’s defense of hydroxychloroquine has caused much controversy in the scientific world. “It’s different there, my client is liable for five years in prison and a 75,000 euro fine,” added his committee. According to him, Martin Hirsch “accused Pr Raoult of falsely testifying under oath that he then relied on AP-HP statistics”.

“there is no match between AP-HP and AP-HM, Pr Raoult was only talking about the lack of funds, the fact that we anticipated things by testing more in Marseille than elsewhere,” stressed Me Grazzini.
