According to a BBC report on Monday, the UK government could be sued over the question of whether leaving the European Union would inevitably lead to a single market exit.
To remove the decision from government control, the pro-EU think tank British Influence will notify Brexit Secretary David Davis that it will conduct a judicial review. This would allow parliament to vote on the country’s membership in the European Economic Area (EEA).
The EEA, which allows duty-free movement of goods, services, capital and labour, covers all EU member states. The government claims that if it leaves the EU, the EEA will follow, but British Influence objected that it must first trigger Article 127 of the EEA agreement, which requires parliamentary consent.
According to Jonathan Lis, deputy director of British Influence, “it is very likely that the UK will act illegally by taking us out of the EEA with Brexit… so we will apply for judicial review. “
“Because Article 127 provides explicit withdrawal procedures, it automatically prohibits other implied withdrawal methods, such as termination of EU membership,” said lawyer Jolyon Maugham.
Dominic Raab, a Brexit campaigner and Conservative MP, alleged that lawyers were “inventing new legal barriers to try to thwart the will of the people”. The government has been embroiled in a second legal battle over Brexit after the Supreme Court ruled that the government must obtain parliamentary approval before invoking Article 50 of the Lisbon Treaty, which sets out informed of the decision to leave the EU.
