The fine is the “highest amount ever imposed” in order to force the state to implement the decision of the administrative judge, according to the press release of the State Council, which three years ago already ruled that the state did not fulfill its obligations against air pollution causing about 50,000 premature deaths. of deaths per year in the country.

Not “enough measures”

During this previous decision of July 12, 2017, the Council of State, requested by the non-governmental organization Friends of the Earth, ordered the state to implement plans to reduce the level of particulate matter, PM10 (diameter less than or equal to 10 microns) and/or nitrogen dioxide (NO2, a pollutant particularly associated with road traffic) in thirteen areas.

But “it cannot be considered that the state has taken sufficient measures to ensure the full implementation of this decision” in eight of these areas, including Paris, Lyon, Marseille, Grenoble or Strasbourg, the highest administrative court insists in its new decision.

The government has six months to act

Taking into account the delay from the previous decision, the importance of compliance with European rules, the “severity of the consequences” in terms of public health and the “urgency arising from”, the Council of State therefore imposed the payment of a penalty of 10 million euros per semester. The government has six months to take action before having to pay this amount.
