An eleventh-hour application has been made to stay the prosecution of a prominent former Sydney politician who flaunted sports cars and designer clothes.

Salim Mehajer, the former deputy mayor of Auburn, appeared in the Sydney District Court on Monday wearing a blue suit and tie and gelled hair.

He is accused of creating two false documents and using those two false documents for his own benefit. Mehajer took the stand Monday afternoon and answered “not guilty” to each of the four charges read by Judge James Bennett.

The 37-year-old is accused of signing a paper for federal court using the fictitious identity of a former attorney to verify his own signature. Ben Hart, Mr Mehajer’s lawyer, however, informed the court that he had been ordered to apply to have the trial quashed.

He told the court that Mr Mehajer had informed him that fresh information might have emerged about two phones which had recently been handed over to Mr Hart’s office.

The phones could not be subjected to Cellebrite analysis, but Mr Hart told the jury there may be a method for a specialist police team to get more information from the phones.

Despite only receiving information about the phones on Monday, Mr Hart claimed there was a “very real chance” they contained “exculpatory material”.

The affidavit related to cellphones, according to the Crown prosecutor, was “quite vague,” he told the court. The prosecutor argued that there was a “high improbability of recovery” and that it was unclear whether the information on the phones would be useful in resolving the issues raised at trial.

“My contention is that there is no real prospect that anything will be achieved by stopping the trial,” he declared.

What evidence might be lost if the data on the phones is successfully recovered, Judge Bennett asked.

The judge asked Mr Hart for further details and continued the case until Tuesday, saying that based on the evidence at hand, he was not currently inclined to dismiss the case.

If Judge Bennett denies the request, Mr. Mehajer will be tried by a jury this week.

Up to 50 criminal charges against Mr Mehajer are pending in NSW courts, and this trial is one of four ongoing cases.
